WRITTEN QUESTION by Eva-Britt Svensson (GUE/NGL) to the Commission
Subject: Abbas Lisani, Azerbaijani political prisoner and prisoner of conscience in Iran
Abbas Lisani, an ethnic Azerbaijani and one of the most prominent human rights activists in Iran, has been imprisoned since 31 October 2006 for his involvement in the campaign for non-Persians' cultural rights in Iran. Abbas Lisani is conducting his campaign in accordance with the Iranian Constitution, paragraph 15 of which states that minority groups have the right to use their own language, apart from Persian, in the press, media and for school tuition.
In Lisani's case, Iran has contravened its own constitution through the judicial process. Abbas Lisani has been convicted for having advocated that minority groups should have the right to express themselves in their own language, i.e. that the constitution should be observed. It is also feared that due process has not taken place and that the prosecuting authority in Ardabil did not give him a fair and impartial trial either in terms of judging the facts or the manner in which the legal procedure was conducted.
1. What does the Commission intend to do in the case of Abbas Lisani? In view of the fact that Lisani is imprisoned for his involvement in the campaign for the cultural rights of Azerbaijanis, rights which are enshrined in the Iranian Constitution, he should be released immediately.
2. What does the Commission intend to do to highlight the general, cultural and political repression of Azerbaijanis in Iran?

The Commission has been made aware of the sentencing of Mr Abbas Lisani, an Iranian citizen, allegedly in connection with his peaceful activities in favour of the cultural and linguistic rights of Azeri-speaking Iranian nationals. It is seeking further information about this case.
The Commission agrees with the Honourable Member that the right to freedom of expression and that of freedom from discrimination are fundamental rights, which deserve to be properly implemented, as these are enshrined in the United Nations (UN) human rights conventions, as well as in the Constitution of the Islamic Republic of Iran.
The EU is following closely the human rights situation in Iran, including the linguistic and cultural rights of people belonging to minorities. Through appropriate diplomatic channels, as well as on the occasion of the EU-Iran Human Rights Dialogue, the EU is raising human rights issues and specific cases with the Iranian authorities
